US Bill to Prevent U.S. Airlines joining the EU ETS

The House of Representatives introduced a bill on Wednesday reports Point Carbon that, if enacted would prevent U.S. air carriers from participating in the EU’s Emissions Trading Scheme. The proposals also instruct US officials to act to ensure that their airlines are not subject to penalties for non-compliance with the EU Directive.
This move comes as a surprise development as the case between the key operators represented by the American Transport Association (ATA) and the European Commission has yet to conclude whether the inclusion of US operators in the scheme contravenes the Chicago Convention and the US-EU Air Transport Agreement, and is unlikely to conclude until 2012.
